The High Court has ordered Inspector General Joseph Bionett and Directorate of criminal Investigations George Kinoto to swear affidavits explaining why they released lawyer Miguna Miguna to the immigration department.
Justice Luka Kimaru also ordered Immigration director Gordon Kihalangwa to swear and file an affidavit explaining how he he took custody of Miguna and ejected him despite the matter being in court.
The vocal lawyer was deported to Canada on Tuesday night via a KLM flight.
According to the government, Miguna was deported because he renounced his Kenyan citizenship.
"Miguna denounced his Kenyan citizenship years back, acquired Canadian citizenship & never bothered to reclaim Kenyan citizenship in the legally prescribed manner neither did he disclose that he had another country’s citizenship despite being a lawyer who should have known better," Mwenda Njoka the Interior Ministry Spokesman stated.
Miguna, however, denied the claims stating that he has never and will never denounce his Kenyan citizenship.
"I have never, ever renounced my Kenyan citizenship and will never do that. I’ve never even contemplated it,” he stated in a statement from Amsterdam.
