A double nomination on gender category has forced Nyamira regional assembly to adjourn sittings until the matter is fully addressed by the court.
Last week, High Court sitting in Kisii quashed an earlier lower court decision to reinstate on Irene Mayaka as duly nominated MCA at the expense of petitioner, Damaris Mouni, who has been serving for months now.
And Speaker Moffat Teya said the assembly had to adjourn because the two nominees were attending assembly sessions contrary to the law.
"The ODM party should address this matter once and for all. Both ladies are using courts to get orders and as speaker, I don't have powers to prevent any of them.
"We had to adjourn because we are supposed to be 36 yet the confusion makes us 37. The matter should be solved urgently," said Teya.
While the ODM party maintains that Ms Nyakerario was the official nominee, Ms Mouni has however maintained that she was validly nominated.
According to a judgment by a Nyamira Magistrate, Ms Mouni's name was illegally sneaked in by an IEBC worker, who is said to be her son, a claim which was confirmed by the court.
Since then, Ms Mouni has been given temporary orders to stop Ms Nyakerario from transacting business on behalf of the ODM party.
