Devolution Cabinet Secretary Mwangi Kiunjuri has urged IEBC and the Jubilee Party to appeal a ruling by the Court of Appeal that the presidential results announced at the constituency level are final.

On Friday, in a far-reaching judgement, five Court of Appeal judges ruled that the electoral agency cannot alter election results announced by its returning officers in the constituencies.

But speaking in Turkana County on Saturday, Kiunjuri disputed the ruling by the Appellate Court, warning that it will plunge the country into chaos if any of the 290 constituency returning officers announce incorrect results.

“If elections are disputed or a returning officer announces results that are not acceptable to either of the parties before that (disputed) case is heard in court, the country will already be on fire,” said Kiunjuri as quoted by Capital News.

Speaking at the same event, Turkana Senator John Munyes echoed Kiunjuri’s sentiments, adding that IEBC chair should be given powers to make any alterations to the results announced by the returning officers.

“We are giving more responsibility to individuals who can collude to determine the presidential results,” said Munyes.

The electoral commission and the Jubilee Party, which had hoped for a favourable ruling, have not indicated if they will be moving to the Supreme Court to appeal the ruling.
