Daraja Mbili traders have threatened to sue Kisii County Government for what they term as negligence whenever their is a fire breakout in the market.
The traders, led by their lawyer George Momanyi, say that the department of disaster management ignored their calls when fire gutted down their goods worth millions.
"In a span of three months we have had fire breakout twice and in all the incidents the county government has ignored calls leading to massive losses," said Mr Momanyi.
They said that they were planning to sue both Governor James Ongwae and the county government.
According to the lawyer, most traders in the market were unable to move on after they underwent massive losses during the two incidents.
"The only way the county will improve on how it responds to disasters is through the courts so that next time they don't repeat being slow," he said.
On Tuesday, traders counted losses after a massive fire gutted down their stalls.
However, Kisii police commandant Hassan Abdi said that their were plans to compensate them.
