The office of the Director of Public Prosecutions (DDP) Keriako Tobiko has termed a court order barring government agencies from probing Mombasa Governor Hassan Joho over alleged forgery of his academic certificates unconstitutional. Assistant DPP Alexander Muteti said security officers have the mandate of investigate a crime of this nature as stated in the Constitution."It is unconstitutional to bar investigations especially where there is no evidence of bad faith on the part of authorities," said Muteti, as quoted by The Star. Muteti asked the court to allow his team to proceed with the investigations without any form of interference. "It is not in order for the court to suspend authority of the Inspector General of Police, the Director of Criminal Investigations and DPP," he said. The prosecutor further told the court that Joho’s move has no basis, adding that the security personnel are only doing their job. "The police are not acting on ulterior motives but are doing their job as stipulated in the Constitution," he added.The ODM deputy party leader was put on the spot for allegedly forging his Kenya Certificate of Secondary Education (KCSE) examination results, claims he has since denied.
