Okello said the servers hold crucial evidence to back Raila’s victory in the concluded August 8th general elections asking IEBC to own up to the malpractices revealed in court and declare him the winner.
“We demand therefore that IEBC must proceed to pronounce Rt. Hon. Odinga as the winner of the August 8th elections. That declaration together with the respective winning certificate must be deposited at the Supreme Court for authentication,” he said.
This, he said was in line with the Supreme Court rules 21 (4) which states that within 14 days of delivery of judgment on its own volition or application by a third party with notice to the other parties the court can correct any oversight or clerical error of computation or other error apparent on such judgment and such a correction shall constitute part of the ruling.
This, he said shall pave way for swearing in on Raila Odinga within the next two weeks and save the country time and resources of holding fresh elections.
“There is virtually no point overburdening Kenyans with another round of elections when the ultimate winner Rt. Hon. Raila Odinga is known,” said the MP.
Speaking at a press conference in Kisumu today, the legislator said IEBC’s refusal to grant access to the servers, disclosure of database transaction logs, GPS coordinates of KIEMS kits among other conditions as directed by the Supreme Court was evidence enough to prove that the elections were a sham.
“The creation of a new electoral team by IEBC is a manifestation and admission that the election body recognizes that the old team bungled the presidential elections and cannot be trusted with any other election,” he said.
IEBC, he said should brace for a litany of court proceeding on contempt if the demands are not met.
