Trans Nzoia Senator Michael Mbito has asked the Eldoret High Court to dismiss an election petition challenging his win in the August 8 general election.
Mbito who testified on Monday in the case filed by former Senator Henry Ole Ndiema told the court that the petitioner had not raised any tangible issues that warrant nullification of his election.
He said numerical errors in the results forms pointed out in the petition affected all the candidates and did not benefit anybody.
"All those errors that the court has been told about affected all of us and I did not benefit in any way as the petitioner has claimed," said Senator Mbito during a cross-examination by his lawyer Benson Gitonga.
"Any allegations leveled against me in this petition are based on hearsay and cannot be a basis of saying the will of the people was not reflected in the final results announced by IEBC," he added.
The Senator presented three witnesses to defend his win as hearing for the petition that has been ongoing for five days came to a close.
Former Senator who lost to Mbito of Jubilee party in August 8 poll is seeking nullification of the election results on claims that it was marred with massive irregularities and illegalities.
The case will be mentioned on Tuesday for further directions.
