A medical doctor from Nakuru Provincial General Hospital was on Tuesday denied custody of a child he sired out of wedlock for allegedly defiling her twice in 2016.Joseph Murika who has been in custody of the child had filed a suit at the Children's Court in Nakuru to seek legal permission to stay with the child terming the mother as 'incompetent'.Mercy Wairimu, the doctor's lover, told the court that the girl has been defiled on two occasions (July 1 and September 28 2016) and sexually assaulted which Wairimu reported to the police.Apparently, the plaintiff filed the suit though he had a pending case of defilement on a separate court.In her ruling, Senior Resident Magistrate Judicaster Nthuku said that the minor has undergone psychological torture under the custody of the father and directed that the mother be the custodian of the child."Though no medical document was supplied to the court to show that the plaintiff defiled the minor, I find him incapable of being in the custody of the child and the mother should. The father shall meet all education and medical requirements of the girl while the mother provides food, shelter and clothing," Nthuku said in her ruling.Murika had changed the names of the child from the initial names in the birth certificate.Nthuku granted Wairimu permission to name the child the initial names a per the birth certificate issued on August 22 2008.The father was however granted access to the child.
