A doctor has filed a case in a local court over the ban on Female Genital Mutilation.
Dr Tatu Kamau has filed a case in the Machakos high Court in a bid to lift the ban imposed on FGM.
Dr Kamau argues that stopping women from undergoing the cut while men do undergo is discriminatory and not in line with the constitution.
She argues that banning FGM is embracing western culture over local culture thus terming local culture inferior.
She further wants anti FGM body to be declared improperly constituted.
"Your petitioner avers that the dignity of traditional practitioners of female circumcision is disregarded. Every citizen has a right to equality and freedom from discrimination but the said Act shows open intolerance to women who wish to undergo female circumcision even for the purpose of upholding their culture. They are treated unequally to the men who undergo similar surgical procedure,” she petitions.
FGM perpetrators are subject to 3 years imprisonment or a fine of sh 200, 000 when caught.
The Somali, Samburu, Kisii and Maasai communities in Kenya record the highest number of FGM cases.
The Machakos high Court will determine whether the case will proceed or not next week.
Dr Kamau has been practicing for 26 years and holds a and a public health degree from Andhra University, India and a master's degree in Public Health from the University of Nairobi.
