Mombasa high court has declined to allow an application by Director of Public Prosecution (DPP) Mr. Noordin Haji that sought to declare documents of a case proceeding, involving a controversial Ivory Kingpin Feisal Mohammed, as missing.
Reading the ruling on Thursday morning Mombasa high court judge Dora Chepkwony said it was too late for the DPP to make the application wanting the documents declared missing thus close files of the suspect in question- Feisal Mohammed."The issue of missing documents should not arise and I declare the appeal submission to continue as the DPP has not submitted his application on a required time according to the principles guiding the rule of law,” said Chepkwony.The state council through Alexander Muteti had made the application asking the court to declare unavailable magistrate proceedings in the case of Feisal Mohamed who was earlier tried and found guilty in a judgment he felt was not fair.
Convicted ivory kingpin Feisal Mohammed Feisal Mohammed was sentenced 20 years in prison after he was found guilty in dealing with ivory trade.
This even as the judiciary system in Kenya is faced with a backlog of undetermined cases at a time when the prisons' capacity has been doubled by the number of inmates placed under incarceration.
