The director of public prosecution Noordin Haji has instructed the Directorate of Criminal Investigations (DCI) to ensure NYS suspects do not present proceeds of crime as securities as they have been granted bail by the high court.
In a letter addressed to DCI head George Kinoti, the DPP raises the issue after an alleged tip-off by the Assets Recovery Agency (ARA).
“Please note to confirm and legitimacy of the securities and funds being presented by the suspects in the above-mentioned cases for purposes of procuring their release on bail and bond. Concerns have been raised by the Assets Recovery Agency (ARA) that some of the funds intended to be used are not only suspect but the subject of the current cases” the letter reads in part.
This move comes as the majority of the suspects went back to court to plead for more lenient terms of release as they are unable to raise the Sh5 million bond or the Sh1 million as cash bail and additional Sh2 million as surety granted by the court.
The suspects are also required to deposit travel documents with the court in a bid to prevent flight risk and those working at NYS offices should only access the premises in the presence of police officers.
