The office of the Director of Public Prosecution (DPP) Keriako Tobiko has instructed the Inspector General of Police Joseph Boinnet to speedily prosecute people who will disrupt or attempt to interrupt Thursday’s repeat election.In a letter to Boinnet dated October 24, Tobiko said a secretariat located at the Office of the DPP (ODPP) in Nairobi shall be on a 24-hour operational basis from October 25, 2017, to November 2, 2017, with contact persons listed as Nicholas Mutuku, Alloys Kemo and Jemimah Aluda.He said during the period, all ODPP offices in the 47 counties will be operational and will be tasked to track all incidents of criminality and/or malpractices related to the repeat elections.“Any person who engages in any acts of criminality either by violence, incitement to violence, threat, hate speech or in any other manner howsoever disrupting or attempting to disrupt the elections be immediately apprehended and taken before relevant special magistrates within the constitutionally stipulated time of twenty-four hours,” the letter reads in part.“In all such cases taken to court, the release of accused persons on bail or bond should be strenuously be opposed. The investigating officers should, therefore, get in touch with the relevant prosecutors to prepare affidavits in opposition to bail or bond.”The letter is copied to Criminal Investigations Directorate Director Ndegwa Muhoro, Ethics and Anti-Corruption Commission CEO Halakhe Waqo and National Cohesion and Integration Commission Chairman Francis ole Kaparo.Kenyans will return to the polls on Thursday to elect their president in an emotive poll that was called by the IEBC following the nullification of President Uhuru Kenyatta’s re-election on September 1.Opposition leader Raila Odinga two weeks ago withdrew his candidatures from the poll.
