Abbas Thakai, a manager with the company narrated to a packed court how the property that was on transit to Shivling supermarket in Kisii town went missing hours after the load was offloaded.

He told senior resident magistrate Judicaster Nthuku that the firm had assigned a driver and his assistant to transport the property to the buyer and had made arrangements for later payments.

“I signed the documents regarding the consignment before l left it in their hands as l trusted them. Later I learnt that the mattresses were offloaded a few kilometres to the town on pretext that the company vehicle could not access the designated destination as result of bad weather,” Abbas told the court.

He said he later discovered that the property had not reached the buyer when he received a call enquiring about the status of the delivery.

Abbas was testifying in a case where a driver, Aziz Saidi Abdi and his assistant Hassan Suleiman Kipyegon are accused of stealing the mattresses.

The court heard that the accused on May 2, 2012 at Industrial area in Nakuru, conspired with others still at large to steal the assorted property belonging to their employer. The accused who are out on a Sh200,000 bond each have maintained innocence and termed the accusations as fabrications.

The prosecution requested for an adjournment to prepare for more witnesses to testify. The court allowed the adjournment and issued summons to Tahn Patel and J Patel who are managers of Shivling supermarket in Oyugis and Migori respectively to appear in court in the next hearing.

The case will be mentioned on November 27.
