National Majority Leader Aden Duale has objected the suggestion to open ballot boxes used in the August general election.
According to a local outlet, Duale, the Garissa Town MP, has called upon the court to throw away a petition by his opponent, Former Deputy Speaker Farah Maalim, as he seeks for the nullification of his results.
The lawmaker has called upon the Independent Electoral and Boundaries Commission (IEBC) not to release the electoral materials as suggested by Maalim.
Through his lawyer Ahmed Abdullahi, the lawmaker said that the application was not only premature but also defective.
On his part, Issa Mansour, who is representing the IEBC, told the court that the electoral commission had realized that the petitioner forgot to write a formal letter within the required 28 days following the declaration of the Parliamentary outcome.
Maalim wants the court to direct the electoral commission under the chairmanship of Wafula Chebukati to avail him all the materials including counterfoils for the polling stations, voter register and electronic gadgets.
Duale, a strong critic of the opposition, has maintained that he won the election in a free and fair manner.
