Garissa Township MP Aden Duale has maintained that he has no case to answer in regard to the August general election.
This is after his arch-rival Ex-MP Farah Maalim took to court to challenge his victory. Duale, also National Assembly Majority leaders, has now asked the court to strike out affidavits filed by Maalim.
According to The Star, the lawmaker has said that the filed affidavits do not meet the legal standard and hence they cannot be used in a suit against him.
On Wednesday, the vocal lawmaker told the court that Maalim’s side was making mere allegation with the aim of derailing the entire process.
He requested the court not to rely on the affidavits in order to overturn the will of the majority of the voters. Duale’s lawyer Ahmednasir Abdullahi argued that the complainant’s failure to swear under the oath makes the entire thing invalid in court.
“By omitting to swear under oath, it is my humble submission they don’t qualify,” lawyer Ahmednasir Abdullahi said, as quoted by the local daily. He further argued that the process will be compromised if the court uses these affidavits.
“The court will be powerless if we find these affidavits have committed perjury,” Abdi said.
