EACC commissioners now want embattled chairman Philip Kinisu to step aside or face suspension as investigations into his family's dealings with the National Youth Service go on.
The commissioners at the same time have written to AG Githu Mugia seeking legal advise regarding the matter.
Thecommissioners include, Sophia Lepuchirit, Dr Dabar Abdi Maalim, Paul Mwaniki Gachoka and Rose Mghoi M. Macharia and CEO Halakhe Waqo.
They want the chairman to take personal responsibility without the necessity of a suspension being invoked under section 42(7) of the Leadership and Integrity Act.
"By virtue of his office and his relation with Esaki Limited, the Chairperson's personal interests are in apparent conflict with those of the public in respect of the subject investigations," read statement signed by commissioners and CEO on Thursday.
Kinisu had earlier said he will not quit and dismissed claims that his company was involved in the NYS scandal saying "it wins and loses tenders much like any other".
