The Ethics and Anti-Corruption Commission (EACC) has pulled out of a case challenging the authenticity of Taita Taveta Governor Granton Samboja's degree.The anti-graft body has said it shall pursue a separate integrity case that is on-going at the Milimani Law courts.Justice Eric Ogola on Friday allowed EACC to withdraw from the case, saying it will not interfere with proceedings, The Star has reported.Armstrong Kiwoi, a voter in Taita Taveta, had included the commission as an interested party in the case he filed before the Voi High Court. Kiwoi wants Samboja's win nullified over claims he forged his academic papers in order to be cleared to participate in the August 8 polls.Kiwoi also sued the Independent Electoral and Boundaries Commission (IEBC) for using the disputed papers to clear Samboja to take part in the nomination exercise.Through his lawyer Edwin Ayiro, the Governor had filed an application seeking the case to be handled by a different court."This case is currently going on at the court adjudicating electoral disputes. The case is not about elections, it is about integrity," said Ayiro.The Governor's documents states that he studied certificate, diploma and degree at Kenyatta University between 2002 and 2009.However, the university through its legal officer Aaron Tanui have since disowned Samboja, stating that the Governor did not study at the institution.Samboja’s petition seeking to bar the court from hearing the case will be heard on December 15, 2017.
