According to the commission, failure to observe the above rule will be considered a criminal offense.
“Failure to submit the declarations is a criminal offense under section 32 of the Act which renders a non-compliant officer liable to, upon conviction, a fine not exceeding Sh1million or imprisonment for a term not exceeding one year or both,” said Halakhe Waqo, EACC Chief Executive Officer as quoted by the Standard.
The CEO further revealed that his commission will monitor the declaration exercise and will ensure the law is followed to the latter.
The law, under section 26 of Public Officer Ethics Act, states that all public officers are required to submit their declarations every two years.
The declarations include that of their income, the assets they own and liabilities of the family, including children under the age of 18 years.
