Kithimani Law Courts on Thursday suspended with costs petition challenging the election of Ekalakala/Ikaatini MCA Stephen Mwanthi.
The petition had been filed by Philip Nzonzi who unsuccessfully contested for the same seat on a Diligence Development Alliance (DDA) party ticket.
Senior Principle Magistrate Gilbert Shikwe threw away the case citing that the evidence adduced by the petitioner could not hold water.
“The petitioner had not proved the case to the required standards, his evidence was not enough to prove any irregularities during the election," Shikwe said.
The Judge declared that Stephen Mwanthi was legitimately elected on August 8, 2017.
The petitioner will foot the cost of Sh1 million to be shared equally among the respondents.
Addressing the press after the ruling, Mwanthi applauded the court's decision describing it as a win for Ekalakala/Ikaatini Ward residents.
“I can now serve my people without fear or favor, I'm not looking back but forward on delivering my promises," Mwanthi said.
