An Eldoret court has blocked the burial of the father to Kakamega nominated Member of County Assembly (MCA) Timothy Aseka due to family disputes over the burial site.

While issuing the ruling, Eldoret Chief Magistrate Charles Obulutsa directed that the burial is stopped until Friday when another ruling on the matter would be made.

The feud arose when the deceased Frederick Amwayi put on his will that he should be buried at the home of his second wife.

However, Luhya tradition indicates that man should be buried at the home of his first wife.

“The deceased left a clear will indicating his site of burial at the home of his second wife and preparation are already complete,” the lawyer representing the second wife argued.

The second wife had argued that the husband's amputated limbs had been buried at her home and would only be fair if the deceased would be buried at the same home. 

"It's only fair that his body is buried in the same location," she said.

The first wife Agneta Oyero lives in Chekalini, Lugari whereas the second lives in Isukha.

The MCA Timothy Aseka had been nominated to represent people leaving with disabilities in the county.
