An Eldoret court has moved closer to giving a ruling in a case in which Eldoret prominent farmer Jackson Kibor is seeking to divorce his second wife, Josephine Jepkoech, whom they have been married for the last 51 years.

This is after Chief Magistrate Charles Obulutsa terminated the hearings for the case that was filed last year.

Obulutsa on Thursday declined to adjourn the case after Kibor's daughter Loyce, failed to appear in court to testify as Kibor's wife witness.

The court was told that Loyce couldn't testify as she was sick but the Magistrate directed lawyers to adopt her statement filed as a basis of what she would have verbally testified.

Hearing for the case has been adjourned for 14 times and Kibor at one time told the court that his wife was using delay tactics to drag the case.

Kibor, 86, is seeking divorce accusing his wife of cruelty and desertion among others.The wife is opposed to the case insisting that she still loves him.

The case will now be mentioned on August 30 where lawyers for both parties will give final submissions before a ruling is made.
