An Eldoret court has dismissed a case challenging the nomination of 17 Members of County Assembly by the Jubilee Party.
Chief magistrate Charles Obulutsa said the petitioner, People Living with Disabilities (PLWDs), did not meet eligibility requirements after failing to remit Sh100,000 to the court.
They had earlier filed an application seeking their case continued without paying the Sh100,000 court fees which the court rejected.
Judge Obulutsa directed that they should now have talks with the accused - IEBC, Jubilee Party and the nominated MCAs - to meet costs.
The court ruled that failure to reach an agreement on how to settle the court cost, the nominated MCAs will have to pay Sh500,000.
The PLWDs now have 15 days to appeal the ruling.
Regina Chumba, chair lady Uasin Gishu County disability umbrella group had moved to court challenging the nominations, seeking inclusion of more PLWDs.
