The Malindi High Court on Friday dismissed election petitions filed against Malindi MP Aisha Aisha Jumwa and her Kilifi North counterpart Owen Baya.Baya’s win the August 8 general 8 was challenged by former Tezo MCA Cosmas Foleni, who filed the petition on behalf of Esther Kache, a businesswoman who vied for the MP seat on a Jubilee ticket.In her ruling, Justice Dora Chepkwon struck out Foleni’s petition against Baya on grounds of being defective, after he failed to deposit security on time.Chepkwon also dismissed Kache’s application to proceed with the case as intended petitioner after failing to deposit the security, the Nation has reported. The Judge ordered Mr Foleni to pay Sh2.7 million for costs incurred during the case.In a separate case, Justice Patrick Otieno quashed the petition filed by Ernest Hizano challenging Jumwa’s win on grounds of filing the case late.In his ruling, Judge Otieno said Hizano failed to follow the appropriate procedure in replacing the original petition with the one in court.Hizano was ordered to pay a compensation fee of Sh2.5 million to Jumwa and Masha Sudi, the Malindi constituency returning office.
