[Photo: Citizen Digital]Political analyst Prof Edward Kisiangani has predicted the possibility of presidential petition following the Court of Appeal decision to allow the Dubai-based Al-Ghurair firm to go ahead and print the presidential ballot papers.Kisiangani, speaking to Citizen TV on Thursday evening, said that the politics surrounding the ballot issue will go beyond the August 8 elections."I won't be surprised if we have a series of petitions after the election where the petitioners will quote the current situation as the basis of their petition. This is not going to die out so long as the political competition continues at the rate at which it is," said Kisiangani.He said that the Court of Appeal violated the constitution in its judgement by placing the legislative law above the Constitution."The judges basically told us that you can pass any law on parliament and that law play superior to the constitution. Article 10 of the constitution upon which the High Court based its ruling, all state officers are bound by the national values in this article and there is no option."If you make a law on procurement and then you say if it is direct procurement that becomes an option in regards to Article 10 on public participation," Kisiangani added.He noted that the Court of Appeal judges made a ruling that is populist but one that goes against the spirit of the constitution.Three judges of the High Court had nullified the Al-Ghurair presidential ballot printing tender saying that the IEBC had failed to follow the laid down procedure.
