Five former students accused of engaging in exam cheating were on Tuesday set free by a Molo court.

The five were accused of being in possession of KCSE exam materials for 2015.

The decision to set them free was arrived at after the prosecution failed to provide sufficient evidence.

James Wanyanga, resident magistrate said the evidence by the prosecution before the court did not meet the description of an examination material as by the law.

He said the printout of questions tabled before the court obtained from a memory card of the first accused student which was sent to the other accused students via WhatsApp was not enough to facilitate the execution of the suspects.

 “Due to lack of evidence, this court will have no option rather than setting the accused former KCSE students free,” he ruled.
