Nyamira governor John Nyagarama's strained relationship with his party boss, Raila Odinga would escalate should the county go for a by election.
Last week, a source within Capital Hill said Raila was 'unhappy' with the governor and would not give him ODM ticket in case of a by election.
"Mzee is unhappy with Nyamira governor and I can assure you that in case of a by election, Nyagarama will not be allowed to run on an ODM ticket," said the source.
The second term governor is fighting an appeal against his victory which was launched by Jubilee's Walter Nyambati.
An ODM lawyer, who spoke in confidence, said Raila is concerned with the governor's continued absence from ODM activities.
"His major concern is Nyagarama's continued missing in action from ODM events such as NGC and NEC.
"Sadly, he does not even send an apology as required. This is getting out of the hands and the ODM boss is not happy," said the source.
Throughout the Sunday's unity rally's across the county, Nyagarama asked both Raila and President Uhuru to visit the county.
During the ODM's agitation for electoral reforms, Nyamira was one of the NASA controlled counties that snubbed people's assembly.
