The Kenya Film Classification Board (KFCB) CEO Dr Ezekiel Mutua has reiterated that the regulatory body will ensure that alcoholic adverts do not appear in the watershed period. According to Mutua, KFCB has court orders barring Kenya Breweries and other brewers from making beer and other alcoholic drinks adverts during the period in a bid to protect children from harmful content.In a post on his Facebook page on Tuesday, Mutua argued that KFCB was ready to challenge the breweries on any legal battle in order to have the orders upheld. "In January last year, KFCB obtained court orders barring Kenya Breweries and other brewers from advertising beer and other alcoholic drinks during the watershed period (5am to 10pm). We argued that there was a need to protect children from exposure to harmful content and that beer and alcoholic drinks adverts were not suitable for the watershed. The judge concurred,” read the post in part.“Now the brewers are here again fighting to have the orders quashed. They won't win. Just like the Digital Migration case, we will fight this battle to the Supreme Court if that's what we must do," he added.This comes after the brewers through the Alcoholic Beverages Association of Kenya filed an appeal challenging the High Court ruling.The brewers through Peter Wanyama argued that the High Court ruling was based on morals and religion and not the law.They further argue that adverts are different from films and thus should be regulated by the Communication Authority.
