A Nairobi court on Thursday ordered that a family that lost their kin through a road accident in Nairobi be paid a compensation of Sh2.5 million by the driver that caused that caused the accident.
According to Resident Magistrate Gesora, the owner of the vehicle KCA 189V, Josephine Mbuthia, and his driver, Zacheus Kuria Mungai, will have to pay the cash or face the jail term.
The deceased, Alex Madaga who is a casual worker in Nairobi was hit by a speeding car while walking along Nairobi's waiyaki way near Thiong'o area.
He sustained the head injuries and on was rushed to private hospitals but was turned away due to lack of Sh200,000.
The hopes of getting him to Kenyatta hospitals proofed futile after the hospital turned him away due to lack of beds in the intensive care unit (ICU).
Alex stayed in the ambulance for up to 18 hours where he later succumbed to head injuries and internal bleeding.
“The deceased was aged 37, he went about his daily chores unhindered and was full of life. He had high expectations in life being a family man and his life was suddenly cut short,” said Magistrate Gesora while issuing the verdict.
The family of the deceased will be paid in four ways which will include, the pain Sh150,000 , special damages Sh189,000, loss of life Sh150,000 and the minimum compensation wage for 20 years which is Sh2,068,248 million.
