A former policeman facing murder charges was on Wednesday found guilty by the High Court in Nairobi.
High Court Judge James Wakiaga found Titus Ngamau Musila alias Katitu guilty of murdering Kenneth Kimani Mwangi.
The accused person who was attached to Kasarani Police Station was being charged with killing Kimani on April 14, 2013 at the Githurai 45 bus stage.
The accused person had denied the charges before the court and through his lawyer, Cliff Ombeta, had asked the judge to acquit him.
Lawyer Ombeta told Judge Wakiaga that the prosecution failed to produce any evidence in court to prove that his client is the one who had shot dead Kimani.
Mr Musila, a popular former crime-buster had become a darling of locals for fighting crime and his arrest had sparked protests in Githurai 45.
When the former officer was arrested in 2014, residents of Githurai 45 blocked Thika Road in protest demanding his release.
Mr Musila told the court that the state has failed to prove that he was responsible for Kimani’s death adding that he had nothing to do with the killing as the bullet did not come from his gun.
Justice Wakianga in his ruling found the accused guilty saying the prosecution has proven its case beyond reasonable doubt.
Justice Wakiaga said although the bullet head recovered from the dead man’s skull did not emanate from the Ceska pistol issued to the accused, there had been an attempt to cover up the murder.
The Judge cancelled the Sh1 million bond which had been deposited in court by Governor Mike Sonko and directed that the accused remain in custody awaiting sentencing on February 27, 2018.
