The NGOs Coordination Board chair Mohammed Fazul has defended a move to freeze NASA principal Kalonzo Musyoka’s foundation bank accounts.
The foundations operations were also suspended.
According to Fazul, he acted in accordance with the provisions of the NGO Act.
He said the foundation failed to comply with the law.
“We wrote to the applicant and asked them to comply with certain directives, amongst them to identify all their banks accounts but it did not,” the Board states in court documents.
Fazul Mahamed, the board’s executive director, thus want the High Court to reject and dismiss a suit filed against Board.
“The case against the NGO board is incompetent, misplaced and an abuse of the court process,” adds Lindos Nicolas, the boards legal Manager.
The dispute arose in May when the organisation accounts were frozen over claims that it could not account for Sh146 million, and had received Sh50 million from China that could not be traced.
The foundation later moved to court seeking orders to lift the orders.
