The ruling of a petition challenging the win of Kitutu Chache North MP Jimmy Angwenyi in the August 8, 2017 polls, will be on February 20.

On Wednesday the petitioners failed to hand in their final submissions despite an earlier agreement that Justice Hellen Omondi fully rely's on written submissions in making its final ruling. 

The agreement came after Dr Robert Ndemo's lawyer Edward Begi,who is the petitioner in the case told Justice Omondi that Angwenyi’s lead lawyer Omwanza Ombati could not make it to the court because he was engaged elsewhere.

Dr Ndemo, an independent candidate moved to court seeking to nullify the election was not conducted on a free, fair and credible manner.

Through his lawyers, Dr Ndemo said there were inconsistencies in Form 35A. 

He has listed Angwenyi, returning officer Eunice Chelagat and the IEBC as the first, second and third respondents respectively.

However, lawyer Daniel Achach, who represented the RO and the IEBC, urged Justice Omondi to dismiss the petition, saying the petitioner failed to prove his case beyond reasonable doubt.
