The fifth suspect linked to the murder of lawyer Willie Kimani and two others was on Tuesday charged.
Peter Kamau is alleged to have driven the taxi used by the three slain men before they were abducted, tortured and then murdered.
High court judge Jessie Lessit however, merged Kamau's case together with the other one where four administration police officers have been accused of killing the human rights lawyer, his client, and a taxi driver.
Kamau was remanded until October 12 when he will re-appear in court for bail application.
Kimani, his client Josephat Mwenda and their driver Joseph Muiruir went missing after a ttending a case at the Mavoko law courts .
Their mutilated bodies were later found in OlDonyo Sabuk river seven days later.
