A Machakos high court sitting before justice Aggrey Muchelule Monday listened to the oral final submissions for the Machakos gubernatorial petition that was filled by Wavinya Ndeti challenging the election of governor Alfred Mutua.
Addressing the high court, the council of the petitioner Willis Otieno said, “amongst our push for the nullification of the Machakos county gubernatorial petition is gross misconduct during the election, county workers who participated in the election knowing that it was an illegal act, and county chief officers having participated in the election.”
Willis added that the first and 2nd respondent, who is the IEBC declared results, without results from over 1300 polling centers which amounted to the nullification of the whole election process.In attendance to give moral support to their NASA candidate were Stephen Kalonzo Musyoka, Musalia Mudavadi, Otiende Omollo, Kitui senator Enock Wambua, and Makueni governor Kivutha Kibwana.
Wavinya was contesting on wiper ticket whereas Dr. Alfred Mutua was on his own party Maendeleo Chap Chap. If the case will uphold the election of the Machakos County governor, his contender Wavinya Ndeti will have to wait until the next general election in 2022 to retry her bid.
Meanwhile, the NASA coalition, whose Wanyinya’s Wiper Party is a member, will be inaugurating its leaders Raila Odinga and Kalonzo Musyoka and president and deputy president respectively.
