A former employee of a Nakuru based textile firm has moved to the Industrial court in Nakuru seeking damages of more than Sh1.2 million for wrongful dismissal.

Robert Simiyu, a former machine operator for the textile manufacturer Spin Knit Limited, wants the court to compel the firm to pay Sh1.2 million as compensation for wrongful dismissal.

Simiyu told the court that his employer sacked him on November 30, 2012 without issuing him a notice for impending termination of his employment and even failed to award him the benefits he was entitled to for his eight year service to the firm.

The former worker who testified in court told Justice James Rika, who was hearing the case, that he started his employment at the company on January 10, 2004.

Simiyu in the suit averred that the ‘rude’ dismissal he received from the company’s management had adversely affected his chances of ever getting employment elsewhere and caused him and his family untold suffering.

Through his lawyer he told the judge that the firm erred in law when it failed to give him notice for impending termination of his services and that he was denied a fair hearing.

Further hearing of the case is slated for November 18.
