The late Dedan Kimathi’s family is facing a law suit over a piece of land located in Nairobi.
Kingsway Industrial Park Ltd has sued Kimathi’s wife and her two children for allegedly planning to get the property in dispute.
Through lawyer Andrew Wandaba, the firm told the court that the National Land Commission and the Kimathi family had planned to take ownership of the land, described as LR No 209/11289.
"Pursuant to the fraudulent and unconstitutional scheme, the second respondent (Mukami –Kimathi’s wife) has applied to the first respondent (NLC) to allocate to it the subject private land," the case filed on April 12, 2017 reads in part.
"The respondents (NLC, Mukami, Wanjugu and Nyawira) have corresponded at length and in depth about the said allotment including by telephone calls in the evening." NLC, led by Chairman Mohamed Swazuri on February 15 wrote to Kingsway, saying they illegally acquired the property.
NLC said due process was not followed in acquiring the property.
