The High Court has made the first move in a case that seeks to compel opposition NASA to take part in the repeat August 8 polls.

Justice Mwita Chacha has directed that National Super Alliance (NASA) leaders be served with suit papers.

The petitioner, Pokot MP David Pkosing was directed to serve Raila Odinga, Kalonzo Musyoka, Musalia Mudavadi and Moses Wetang'ula with the papers.

"Let the petitioner file and serve respondents with the suit papers and parties come back for further directions on October 9," Mwita stated.

In the suit, Pkosing claimed that NASA has an elaborate plan to intimidate supporters. 

 He claimed that the Opposition was also planning to challenge the validity of the entire election. He asked the court to declare that any action by Odinga, Musyoka or any of the NASA principal to stop the repeat presidential election an act of treason.

NASA has maintained that it will not take part in the polls until IEBC CEO Ezra Chiloba resigns over accusations of mismanaging the August 8 presidential polls whose results were nullified by the Supreme Court.
