Five people have been accused of murdering primary school student Jeremy Masila, July 21 in Majengo.

Emmanuel Okanda who is the traffic boss stated that Jeremy was crushed while trying to collect his belongings after they fell through the floor plate of the bus.

The accused who were expecting to face traffic charges were shocked when the ODPP had asked for murder charges.

Sara Kesi, Venant Mwaliko, Vald Mbadi, Abdenego Mwendwa and Charo Kazungu are among the accused.

According to reports the accused are to be arrested and brought to court following a court order from High Court judge Dora Chepkowny.

The lawyers representing the suspects have emphasized their remorse.

“The accused have apologized and the family has accepted that it was an accident which was unavoidable,” one of the lawyers said as reported by The Star.

A constitutional petition has been filed by the lawyers to the court in an attempt to review the charges they believe are too harsh.

DPP Alexander Muteti has asked the High court to order the suspects to undergo check-ups for mental stability to verify if they are fit to stand trial.
