The five Joshua Kiprop,Steven Maiyo,Lawrence Kipkurui and brothers Patrick and Raphael Tipis were acquitted of murder charges by the Nakuru High court on Monday September 26 over lack of evidence.
They were being accused of murdering Michael Kiptoo at Mogotio's Kipsogon village some time back.
While giving out his judgement,the presiding judge, Justice Maureen Odero termed the presented evidence as weak and unable to prove that the five and others not before the court indeed murdered the deceased. She further said that the allegations were based on suspicion.
Part of her judgement read: "The evidence presented against the accused persons was based on suspicion that they committed the offense. Since suspicion alone cannot form a basis for conviction, I acquit them of the charge and the accused are set to liberty,"
No witness during the proceeding could identify the five .
A postmortem test carried out however proved that the deceased was hit by a blunt object on the head.
