A forgery case against Kapkures ward MCA Paul Kimtai together with his close aide Richard Langat on Wednesday failed to proceed after the defense applied for an adjournment.

Through lawyers Steve Biko and Gordon Ogolla, the court heard that they were unable to proceed with the matter citing lack of crucial documents from the prosecution.

"On my part I am not ready to proceed with the case, I don't have all the documents for the case and I request for an adjournment in the matter to a later date," said Biko.

Chief Magistrate Josephat Kalo allowed the application for adjournment and moved the matter to July 19 for hearing.

"There being no objection for adjournment the case is hereby moved to July 19 for hearing," ruled Kalo.

The duo had been charged that on diverse dates between the month of October 2010 and April 2012 at an unknown place with intent to defraud Josiah Njoroge without lawful authority made a title deed of a land situated at Mbaruk area in Nakuru purporting to be a genuine document issued by the lands registry.

They faced other charges of giving false information to police about the said land which led to the wrongful arrest of an advocate in Nakuru.

The two had pleaded not guilty and are out on a Sh200,000 bond with a surety of the same amount.
