Davis Wambua a form three student at Kalukuni Secondary School in Yatta Sub- County was on Friday arraigned in Kithimani court for harassing a form one student.

Wambua was accused of harassing a minor, form one student who has joined the school.

This comes after the parents of the victim moved to court on Tuesday complaining of physical and social assault of their son.

Joseph Mwanzia the victim narrated different incidences he was teased and harassed by the senior student since he joined the institution.

“I am in the same dormitory with him. Since the time I joined the school he has been mistreating me in front of other students,” said Mwanzia.

"On Monday he dragged me out of the dormitory and ordered me to kneel outside. He then took a panga and threatened to kill me,” says Mwanzia who adds that he has never done anything wrong to him.

In his ruling Kithimani Court Magistrate, Davis Karani, said that the senior student had been found guilty of disturbing peace in school and relentless bullying a form one student.

He added that the accused has been violating Mwanzia's right which is against the law and is prohibited in education code.

Kenya Constitution Chapter 4 article 25(a), every Kenyan is protected from torture and cruel inhuman or degrading treatment or punishment.

Davis Wambua pleaded guilty to the accusations and was referred to disciplinary probation program as he awaited his next hearing.

The case is set to be heard on March 12, 2015.
