Former Law Society of Kenya chair Okongo Omogeni has termed Attorney General Githu Muigai’s proposal to postpone the August 2017 elections as ‘myopic and illegal’.
Githu made the proposal on Wednesday when he appeared before a parliamentary select committee on IEBC reforms.
The AG contended that the period will allow ample time for the reconstitution of the electoral commission to curb any future poll disputes.
And now Omogeni says the proposal could be a scheme to extend the president's term and that of Parliament contrary to the provisions of the Constitution.
“The AG understands the law very well and he knows that his proposal is myopic and illegal. He should not hoodwink Kenya’s juts because he wants tax payer’s money to be misused,” he said.
“Extending the election date will be trying to illegally extend the term of Parliament and the president without following the Constitution. The date should remain intact since reforms can be done within a short period. We are only replacing the commissioners and not all the workers,” added Omogeni.
Omogeni who is eyeing the Nyamira County senatorial seat said the proposal could only be validated through a referendum as provided for in the Constitution.
“The extension of Parliament and president’s term can only be done through a referendum in case there is no state of emergency. That is a simple and basic provision that the A should argue from,” he said.
