Former Nakuru Mayor Mohammed Surraw, who claims ownership of the disputed Naka land in Nakuru County, has accused the prosecution of failing to take action in prosecuting Nakuru Town East MP David Gikaria and others involved in the demolition of a perimeter wall earlier last month.
Through their advocate Gordon Ogolla, they stated on Thursday in a Nakuru court that the prosecution and the police are afraid to arrest the law maker and no efforts have been made in regard to prosecute the accused persons.
Ogolla and Co. advocates went forward to file an application to have a private prosecution on the matter.
“We are seeking orders that the court grants our wish to move forward with a private prosecution on the case since there is no commitment on the part of prosecution and police”he said.
The former Mayor is claiming ownership of the disputed 10-acre piece of land which is in a tussle with Naka primary School.
According to the prosecution led by Hillary Songoyo, the allegations stated by the complainants are false and that they are not protecting the accused persons in any way.
The complainants want the prosecution of Nakuru Town East MP David Gikaria, activist Boniface Mwangi, Elijah Kinyanjui and Flamingo ward MCA Moses Gichangi.
“The prosecution has not shown any charge sheet before court to show that the MP and others have been charged and no summons has been made to either the investigation team or the witness,” Ogolla said.
