Jomo Moya filed a case against the Kenya Army Service Commander, the Attorney General and the Defence Council saying that his fundamental freedoms and rights had been infringed in the dismissal.

Through his lawyer Wilfred Kinoso, Mr Moya said he was denied the right to a fair trial, further claiming that he was also not informed of the dismissal decision against him.

"The sudden unlawful loss of employment without any benefits and without any due regard to his long service has been traumatic to him and his family," said Mr Kinoso.

He further said that the duo of Service Commander and Defense Council failed to pay him his termination monies as well as his pension.

Moya was dismissed October last year after serving KDF for 30 years.

He was sacked after Corporal Evance Akelli lodged a complaint claiming that he (Moya) had solicited a Sh10 000-bribe from him following Moya’s arrest over felony.
