Nyamira county is set for another legal battle after former Kitutu Masaba MP Walter Nyambati filed a record of appeal against a High court ruling that validated the election of Governor John Nyagarama.
Nyambati who lost the gubernatorial seat to Nyagarama filed the record of appeal at a Kisumu court on Monday.
Nyagarama amassed 63,494 votes winning against Nyambati who followed him closely with 58,936 votes.
In a quick rejoinder outside the court premise, Nyambati insisted that the gubernatorial election in the devolved unit was masked with dishonesty.
When Justice James Makau struckout the petition, he stated that Nyambati was unable to demonstrate to the court how irregularities played during the election.
“We have accrued more evidence and also have two more personnel in our legal team so as to give impetus to this appeal,” stated Nyambati.
His lawyer Osoro Mogikoyo exuded optimism that their fresh legal battle will show that the High court Judge was not fair on his verdict.
“After recount and scrutiny orders were awarded and implemented, the exercise revealed that there were many discrepancies that even culminated to the dismissal of North Mugirango Returning Officer. We were left agape when the court still upheld such an election,” stated Oroso.
Nyambati will be back in court on April 11 when a pre-trial in to the case will start..
