Judge Raymond Langat said the ODM county lawmakers were illegally in office following a petition by 9 voters on the Luo Nyanza county.According to the judge, Political Parties Tribunal provided a list which was to be harmonised by the ODM party before names of the affected MCAs could be gazetted.Langat ruled the nominated MCAs were in office illegally and termed ODM's nomination list as null and void.The court further directed the Raila Odinga-led party to gazette the list from Political Parties Tribunal.

The affected MCAs include:

Respondent's lawyer, Christopher Ojwang opposed the ruling saying the court based its evidence on Political Parties Tribunal and vowed to challenge the ruling.
