A Garissa County MCA has vowed to table a motion in the House seeking to ban Maslaha which is widely used to solve rape cases locally.
Nominated MCA Fatuma Abdi said that rapists will not be spared with law using barbaric means of solving serious offenses.
"Rapists have gone unpunished because of the use of maslaha. I am preparing a motion which I will table before the assembly to ban the use of maslaha in the county. Our communities should shun using poor means of solving serious offences because no one is above the law," said Abdi.
According to the MCA, rapists should be subjected to the laws of the land."Elders must be compelled to stop using Maslaha to solve rape cases. The motion I will table will have the elders promoting Maslaha punished accordingly," Fatuma said.
She said any elder found participating in Maslaha will be jailed regardless of his or her role in the society.
"As women leaders, we have agreed to mobilize our male counterparts to ensure that this Bill passes without any hitch once I will table it,” she added.
She was speaking on Thursday during the International Women’s Day celebrations at Garissa primary school playgrounds.
