A High Court judge has defended his earlier judgement where he ruled that homosexuals had the right to register their organisation.

Justice Isaac Lenaola told the Judicial Service Commission (JSC) that he had based his ruling on the constitution which espouses the rights of all Kenyans including gays as well as the bisexual and transgender.

Lenaola said that he had made the decision because according to the constitution, citizens are free to form associations that they consider important to them as long as they interfere with the rights and freedoms of others.

“The constitution recognises that people have a right to form associations and associate with their kind and this is what guided my judgment on the matter,” he said.

Speaking on Wednesday during the grilling for the vacancies in the Supreme Court judge, Lenaola was also put to task to explain a ruling he earlier made to support the eviction of Muthurwa residents in Nairobi.

“In that case, I had the rare opportunity to give direction is such matters; I ruled that it was wrongful to evict people at night, destroy their property, or even forcefully evict them,” he said.
