Gatundu North IEBC returning officer on Tuesday told the Kiambu High Court that elections materials were found dumped in a forest in the county.
Mr. Patrick Gakuru was testifying in a case filed by former Gatundu North MP Clement Waibara who is challenging the victory of Ms. Ann Kibe.
Returning officer Gakuru told the court that the ballot papers found dumped and scattered in a forest were genuine.
Mr. Gakuru further said that clerical errors could not have affected results from the August 8 general elections as there was a margin of over 30,000 votes between Waibara and Kibe.
Mr. Waibara had claimed that fake ballot papers were recovered in a thicket and in dustbins by the police on August 20 and they bore official IEBC stamps.
He told the court that there was no justice for Gatundu North residents since pre-marked ballot papers were stuffed in boxes after voting was closed.
According to Mr. Waibara, the elections were not free and fair as required by the constitution arguing that there was no proper collation, tallying and tabulation of the results adding that the election was characterized by massive irregularities.
The former MP also claimed that there were cases of threats and violence which he argues undermined voters' ability to take part in the exercise.
