Nyamira county governor hopeful James Gesami has been given go-ahead by the High Court to run for the Nyamira governor seat.
The court dismissed a petition challenging the suitability of him contesting.
High Court Judge John Mativo said the petition relates to nominations and the complainant Kenneth Morande should have utilized the mechanisms provided under the IEBC Dispute Resolution Committee.
“Morande ought to have challenged the issue of nominations before the IEBC Dispute Resolution Committee before going to court. He ignored the laid down mechanism,” Mativo said.
Morande had sued the former West Mugirango Mp, IEBC and EACC over allegations that Gesami is not suitable to vie for Nyamira gubernatorial seat.
Morande accused the IEBC for clearing Gesami yet he did not meet the constitutional requirement and his integrity is questionable.
Justice Mativo ruled that since documents were filed showing that Gesami was cleared and acquitted of criminal charges, Morande’s arguments had no merit.
“The upshot is that Morande’s allegations are baseless, shallow and in my view mere vendetta and the court is unable to attach any weight on them,” said Mativo.
