Former Nakuru Mayor Mohammed Surraw has accused Nakuru Town East MP David Gikaria of using the Parliament to sabotage an ongoing land case before a Nakuru court.

Appearing before Chief Magistrate David Kemei on Monday, the former Mayor through his lawyer, Kipkoech Ng'etich accused the legislator of tabling a petition before a parliamentary committee to discuss the ongoing land tussle case.

He argued that if Parliament moves forward with the hearing of the petition it would result to a constitutional crisis since the judicial powers strictly lies with the court.

According to Surraw, who claims ownership of the land, Parliament has no powers to hear the matter.

In the petition tabled in Parliament, the MP has urged the committee to investigate and determine the real owners of the land in question despite having an ongoing case in court.

Gikaria together with four others are facing charges of malicious damage of property where they are accused of bringing down a perimeter wall on a disputed land between ENSE Limited , a company owned by the former mayor and Naka primary school in Nakuru.

In his ruling Chief Magistrate David Kemei declined to issue any orders but instead directed the case be fixed for a hearing on another date.

The matter was slated for hearing on November 28 for hearing.
